Colorpic Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the ColorPic mobile application for iOS and Android (the “App”), operated by Really Good Products LLC, a Delaware limited liability company (“Company,” “we,” “our,” or “us”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to create an account without parental consent. Users under 13 may only use the App with verifiable parental consent where required by law. The App is not intended for children under 10–11 years old.
By using the App, you represent and warrant that:
- You have the legal capacity to enter into these Terms.
- You are not barred from using the App under any applicable law.
3. Account Registration and Security
Some features may require an account. You agree to:
- Provide accurate and current information.
- Keep your login credentials secure.
- Be responsible for all activity under your account.
We may suspend or terminate your account at any time, for any reason, without notice or liability, including for violation of these Terms.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful, misleading, or harmful purpose.
- Harass, abuse, or harm others.
- Post or upload content that is threatening, obscene, defamatory, or otherwise objectionable.
- Reverse engineer, decompile, or disassemble any part of the App.
- Use automated scripts, scrapers, or bots without written permission.
- Upload or distribute viruses, malware, or other malicious code.
- Use the App in a manner that could damage or impair our servers or networks.
- Use AI outputs for unlawful, harmful, or deceptive purposes.
We may remove content or restrict access at any time, without notice, if we believe these rules have been violated.
5. AI Features and Disclaimers
ColorPic may include AI-powered features that transform or generate images.
By using these features, you acknowledge and agree that:
- AI-generated outputs may be inaccurate, incomplete, or misleading.
- We make no guarantees regarding the accuracy, legality, or suitability of AI outputs.
- You must not use AI outputs in ways that violate any law or infringe third-party rights.
- You are solely responsible for verifying and using any AI-generated content.
- We may store anonymized AI interaction data to improve the App.
All AI-generated content created within the App remains subject to these Terms and to applicable intellectual property laws.
6. Intellectual Property
All content, source code, designs, and branding in the App are owned by Really Good Products LLC or its licensors.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our express written permission.
7. Payments and Subscriptions
Payments and subscriptions are processed through the Apple App Store and Google Play Store via RevenueCat.
- Subscriptions automatically renew unless canceled before the renewal date.
- Prices may change with notice in accordance with App Store / Play Store terms.
- Refunds are handled by the platform where you made the purchase (Apple or Google).
- We do not provide direct refunds except where required by law.
8. Termination
We may suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms or applicable law.
You may delete your account at any time through the App settings.
9. Disclaimer of Warranties
The App and all related services are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The App will be uninterrupted, secure, or error-free.
- Any defects will be corrected.
- The App or servers are free from viruses or other harmful components.
10. Limitation of Liability
To the fullest extent permitted by law:
- Really Good Products LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App.
- Our total liability to you for any claim related to the App is limited to the amount you paid to us, if any, in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Really Good Products LLC and its affiliates, officers, and employees from and against any claims, damages, liabilities, or expenses arising out of:
- Your use of the App or any content generated through it.
- Your violation of these Terms.
- Your violation of any applicable law or third-party rights.
12. Dispute Resolution
Binding Arbitration: Any dispute arising from or relating to these Terms will be resolved by binding arbitration in Delaware, USA, administered by the American Arbitration Association (AAA).
No Class Actions: You agree to bring claims only in your individual capacity, not as part of a class or representative action.
13. Force Majeure
We are not responsible for any failure or delay due to causes beyond our reasonable control, including natural disasters, government actions, internet outages, or labor disputes.
14. Assignment
We may assign or transfer our rights and obligations under these Terms at any time. You may not assign your rights without our prior written consent.
15. Modifications to Terms
We may update these Terms at any time. Updates will be communicated within the App. Continued use after updates constitutes your acceptance of the revised Terms.
16. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions.
